When convicted of a
crime in Circuit Court, the judge may assess fines, costs,
probation fees, attorney fees and restitution. Court
ordered obligations are due at the time of sentencing pursuant
to MCR 1.110. Extension of time to pay are granted only
on the basis of need and at the request of the defendant either
in writing or on the record.If
the assessments are not paid, nor any payment arrangement made,
56 days after sentencing, the court will assess a one time 20%
late fee on the total amount due (not including restitution).
If the court grants a payment plan, a
portion of the assessment may be required at sentencing and the
remainder paid as part of a defined payment plan.
Generally, the payment should be a minimum of 10% of the amount
due or an amount necessary to have the balance paid within one
year; or one month prior to probation ending, whichever is
earlier.
Unless specifically directed by the
court, if an individual has multiple debts owed, payments will
be applied to the oldest debt first.
